I've never done this to my phone but I can't see how it is constitutes illegal activity.

Because you could potentially download free stuff. I jailbroke mine once. It was neat having animated wallpaper for a week till I got bored with it.

Not if you're getting a continuing service from them. Phones, game systems, etc. fall into this, in my opinion.

I think it should void your warranty, but that's it. If you use jailbreaking to actually steal, that's another issue.

When you jailbreak a phone...take it to what ever company you want. You pay for the phone once. The continuing service is what you pay for...not the item.

I could download free stuff from my computer and put it on my "legal" phone now.

well that's not necessarily true

Can you turn your house into a burger place? probably not

Can you let your grass grow a foot high? probably not.

Can you start bonfires in the back yard? probably not.
