So this rebuilt Normandy with EDI and the crew and everything is under his command. The Earth military can neither ground him for that last DLC or anything he does anymore, wouldn't he be under his own authority?

You know that it's possible to play the entire second game without losing your Spectre status. And despite being a council Spectre, Shepard has always been considered part of Alliance military. And if they declare Shepard dead, does it make more sense to act as if no military laws can touch him? Or to reverse their declaration of his death? They're not gonna say, "Oh shit...we were totally wrong about you being dead, huh? Oh well; guess we just can't prosecute for anything you may have done. See ya."
So, Shepard is still Alliance.

Shepard is relieved of command and duty early in the game. The Normandy has been seized, examined and...not so much rebuilt as refitted. Presumably, they've gutted the computer systems and rebuilt them, to clear out any nasty code TIM may have had inserted. They gave her a new paint job and put her back into service as SR-2.
In the demo, Shepard only gets reinstated at Anderson's discretion,
after the shit has well and truly hit the fan.
The thing that doesn't sit well with me is retaining EDI. She's a Cerberus AI, and as such, it makes no kind of sense for the Alliance to take the chance that her systems could ever truly be scrubbed clean of hidden surprises. I certainly wouldn't want the AI controlling the life support systems to suddenly succumb to some hidden programming. Shit, if she can't be extracted from the control systems, I'd just as soon yank the tantalus core out and shove it into and entirely different ship. I mean, according to the novels, Normandy is no longer the only ship with such an engine core.
But, maybe Admiral Hackett figured that toaster's got a sexy voice. And maybe they figured, if they give her a sexy robot body, she'll look totally hot in a tight red skirt.
Or, to put it slightly more succinctly; IT'S MAGIC, BITCH.
