The Burroughs estate is going to lose the crap out of that lawsuit.
Anyways, trademarks are an entirely different matter as that regards only to things like the Bat-symbol, the Superman Shield etc, as well as the branding of comics.
For instance, no other comic would be able to title their comic Superman, but they sure would be able to use a character called Superman in the book (see the Captain Marvel thing).
