its hard to tell, since this issue also had the Justice League in it.. and Superman wearing the modern costume, and the t-shirt costume

Action Comics, like Justice League, started out 5 years ago. They both just caught up to the present in the last 2 issues. So maybe as of this issue Kal is still transitioning outfits.

Superman got his new outfit five years ago, at the end of the first Action Comics arc. This storyline is happening in the past, because we know from #5-6's interlude storyline that Nimrod will be able to shoot Superman with a microscopic pellet filled with his enemies that will become lodged in his brain, and dealt with by the modern day Superman.

Action Comics #5-6 is an interlude to the opening storyline in the book. The modern-day Superman (along with a few members of the LSH) track down the DCnU's equivalent of the Superman Revenge Squad, and discover that they are hiding in a tesseract that is placed within a microscopic pellet embedded in Superman's skull.
